W ostatni piątek lutego Przed Sądem Apelacyjnym w Katowicach zapadło rozstrzygnięcie w sporze z powództwa Nestle przeciwko Mokate. Przedmiotem roszczeń ze strony Nestle było zaniechanie przez Mokate używania kilku wersji opakowań jako nadmiernie zbliżonych wizerunkiem do opakowań Nestle. Orzeczenie Sądu okazało się korzystne dla polskiej spółki Mokate.

Zarówno firma Mokate jak i wybitni polscy eksperci z zakresu praw niematerialnych, od początku sporu uważali, że roszczenia koncernu szwajcarskiego są całkowicie nieuzasadnione i - jak się wydaje - są próbą pozarynkowych oddziaływań na konkurenta. Mokate jako jedna z niewielu firm krajów Europy Środkowej i Wschodniej od wielu lat skutecznie konkuruje z firmą Nestle zwłaszcza w kategorii kaw zabielanych a przede wszystkim cappuccino. Polska firma na rynku polskim legitymuje się około 80% udziałami zaś Nestle nie jest w stanie przekroczyć 10% (dane Membr 2008).
