FoodCare wznawia produkcję i sprzedaż „Tigera"

Sąd Okręgowy w Gdańsku wstrzymał wykonanie postanowienia z dnia 1 grudnia br. o zakazie produkcji, sprzedaży i promocji przez FoodCare Sp. o.o. (firmy z podkrakowskiego  Zabierzwa) produktów energetycznych w opakowaniach zawierających oznaczenie z elementem „Tiger". Dla firmy oznacza to możliwość wznowienia wytwarzania i wprowadzania do obrotu napojów popularnej marki. 

Postanowienie z dnia 1 grudnia br. zostało wydane na wniosek Fundacji Dariusza Michalczewskiego „Równe szanse" dla zabezpieczenia powództwa w sporze o prawa do marki, który od dwóch lat rozpatrują Urząd Patentowy oraz krakowski sąd.

W wyniku decyzji sądu w dniu 8 grudnia br. komornik zajął produkty znajdujące się w magazynach i fabryce FoodCare Sp. z o.o. w Niepołomicach.

Spółka FoodCare zaskarżyła zażaleniem postanowienie z dnia 1 grudnia br. 23 grudnia br. Sąd wstrzymał wykonanie tego postanowienia.

„Byliśmy przekonani, że Sąd rozpoznający zażalenie podejmie decyzję korzystną dla FoodCare. Dla konsumentów oznacza to dostęp do oryginalnego napoju Tiger na bazie stworzonej przez nas receptury" - mówi Wiesław Włodarski Prezes Zarządu FoodCare Sp. z o.o.
