Inspektor działający z ramienia Inspekcji Handlowej jest upoważniony do przeprowadzenia kontroli po okazaniu legitymacji służbowej oraz stosownego upoważnienia. Przedsiębiorca ma obowiązek umożliwienia upoważnionemu inspektorowi przeprowadzenia czynności kontrolnych, które mogą polegać m.in. na oględzinach obiektu handlowego lub pobraniu próbek produktów.

Uniemożliwienie lub utrudnianie przeprowadzenia czynności kontrolnych może skutkować wymierzeniem osobie odpowiedzialnej grzywny w wysokości do 5 000 złotych lub kary aresztu do 30 dni. Dodatkowo, w celu zapewnienia możliwości przeprowadzenia kontroli organy Inspekcji mogą zwrócić się o pomoc Policji.
