Towar żywnościowy niezgodny z umową także można reklamować. Kupujący (konsument) powinien zawiadomić sprzedawcę o wykryciu niezgodności nie później niż:

• w terminie 3 dni od dnia otwarcia opakowania - w przypadku towaru paczkowanego,
• w terminie 3 dni od dnia sprzedaży lub otrzymania towaru - w przypadku towaru sprzedawanego luzem, odmierzanego w miejscu zakupu lub dostarczanego do miejsca zamieszkania kupującego.

Zawiadomienie takie należy złożyć przed upływem daty minimalnej trwałości towaru lub terminu jego przydatności do spożycia (jeżeli taki termin został określony).
