Wraz ze zmianami w ustawie o transporcie drogowym, które weszły w życie z dniem 01.01.2012 roku, wprowadzona została osobista odpowiedzialność kierowcy za zawinione naruszenia obowiązków lub warunków przewozu drogowego.

Do tej pory odpowiedzialność spoczywała na przedsiębiorcy zlecającym przewóz. Teraz kierowca odpowiadać będzie za złamanie okresowych ograniczeń lub zakazów ruchu, za skrócenie przerw lub odpoczynków kosztem wydłużenia czasu prowadzenia pojazdu. Karę za naruszenia także zapłaci kierowca, a nie jak dotychczas przedsiębiorca. Maksymalna kwota grzywny to nawet 2 000 złotych.
